Can you get charges against you if you accept a package during a controlled delivery, even if there is no other evidence against you?

Like in the title. Also, if simply accepting the package won't get you charges, what kind of evidence do they need in order to press charges?

Accepting the pack shouldn't be the end of the world. If it is a CD and they use the pack as evidence to search your residence, and you have a clean house, you should be fine. Just remember to DENY EVERYTHING. Don't answer questions, stick a believable story, "I didn't order this, I don't know what's in the pack". LE will want to make you think they have dirt on you in an attempt to get you to crack, but always deny and you should be fine. If you're suspicious that's it's a CD, its best to not open the pack at all and wait it out. But if you're 100% sure, mark as return to sender and get it the fuck out of the house.

Pce n love stay safe Edit: "Deny Everything" meaning any questions regarding if you know what's in the package, say no. My word choice is weak lmao, don't say anything that can be held against you.

[8 Points] blockmains:

They need you acknowledge that the pack was for you which in most courts is accepted as opening the pack which indicates you were expecting it.

If it is a signed pack and you sign for it that is good enough to press charges but it may or may not stand during trial, depends on your lawyer.

Charges yes, but I saw a cop posting in /r/drugs that said if you don't talk and have no other connection to the pack your odda kf being convicted are very small.

[4 Points] DrParagon:

People have. Don't believe anyone who is not a lawyer. They're charging you with possession because it is in your residence. They can deliver it to your girlfriend at your place and then arrest you at work, you'll never even know it's there.

[3 Points] Theeconomist1:

Charges are very different than a conviction. You can get charged with anything. If there is literally no evidence against you other than the pack itself and you didn't say anything during the CD, my guess is that charges would be dropped. I couldn't imagine a conviction based just on that. They'd prob charge you, try to plea you, and if you don't bite, they'd prob drop the charges.

[3 Points] DaDankWank:

"A controlled delivery is delivery of a parcel, package, or envelope containing narcotics under controlled circumstances that has been sent either via a commercial private parcel company or the U.S. Postal system. The actual physical delivery is typically made by a police officer in an undercover capacity, or by the U.S. Postal Inspector if the parcel is U.S. Mail. Under these controlled circumstances, the objective is to have a law enforcement officer make the delivery of the parcel to the suspect, who will either sign for or take custody of the parcel. The undercover agent will attempt to solicit any statements in which the suspect may admit knowledge of the parcel delivery. The key to any parcel investigation is for law enforcement to prove that the subject had knowledge of the parcel’s contents. This is critical to the prosecution of the suspect in a parcel investigation. It is virtually impossible to litigate a criminal case without proving knowledgeof contents."

which is from the book Drug Interdiction: Partnerships, Legal Principles, and Investigative Methodologies for Law Enforcement (See excerpt here: https://paste2.org/6341LfJ1 )

The first italicized part of the quote, to me, seems to liken signing for the pack to simply taking possession of it, while the second italicized part of the text leads me to believe that self-encrimination is ultimately the be-all-end-all for litigating a criminal case against a drop house.

If it were possible to litigate criminal cases against people for simply signing for a package which contained drugs, then it would be possible to set people up for felony drug charges, and would probably be a pretty common thing. (Sending a pack full of drugs to politicians to discredit them, sending them to competition, disliked people, etc). It would make fucking over others way too easy, which is why i don't think signing for a package and leaving it unopened is enough for the CD to result in actual charges.

I drill my drop houses to know they have a right to remain silent, and to know their backup story: "I signed for the package because i was curious as to what it was, and after examining it i noticed it was from [insert country], and since i don't know anyone from [insert country] i started to get paranoid. I've heard about anthrax and poisons being sent through the mail, so i decided to return it to the sender and just hadn't gotten around to it yet..." in case they're brought in for questioning and want to say anything at all.

If you're going to make counter claims, please provide sources to case files or to first hand accounts of the occassions you're referencing, don't just call me an idiot and give an opinion. Please give sources for your opinions.
