You would both have access to the BTC attributed to the address. Would those BTC be free? No, if you took them that would be theft and you'd be a dick.

I remember some guy on here a couple weeks ago kept updating his deposit address on blackbank and apparently ended up getting a bunch of btc from people who had sent to old addresses on accident. I think they fixed it now so you can't do that anymore. I was actually one of the idiots who sent to an old wallet address. I assumed my btc was lost due to my mistake but blackbank actually made it right for me.
