Legality of selling U-47700?

My friend apparently sold U-47700 to someone and they set them up telling the cops it was heroin. If the person setting them up wore a wire and the person said "if you shoot up, you don't need a full bag because it's strong" could they get in trouble or will they be fine when the lab results come back? If you are selling U-47700 do you need to say it's for research purposes only? This happened in USA in a U-47700 legal state.

EDIT: Friend did not sell it at heroin, snitch is just a dumb fucking cunt. If you can't get past that then please just answer this question. IF IT WAS SOLD AS U-47700 WILL THE PERSON STILL GET IN TROUBLE? I understand if it is sold as heroin, they would get a heroin charge. Just wondering about selling it for what is it now.

In my state if you try to pass off a fake substance as scheduled drug you get charged with selling the scheduled drug.

Your idiot friend sold it as heroin and told them it was for consumption with the shooting up line. It doesn't matter if he had simply crushed up B vitamins in the bag; he sold the product as drugs. Hopefully this is his first offense. He will get charged, but to what degree depends on a variety of factors.

If he sold it for non human consumption, then he might be able to get away with it. being on tape saying "if you shoot up, you don't need a full bag because it's strong" is kind of incriminating. i think if they catch a smoke shop employee saying something other than for non human consumption they get a fine and can't sell anymore or something. think of it like in a bong store they call it a "water filtrated tobacco pipe" so even its legal selling intended for human consumption will probably cost him a fine or worst case scenario a scheduled narcotic charge for selling a fake narcotic.

TheSm0ker is right. It doesnt matter if it was heroin or not. It's illegal to advertise the sale of a substance as an illegal drug. Doesnt matter if its U-4, if he sold it as heroin he is fucked. All he would have had to do is straight up tell him that its U-4, and he would be perfectly fine.
