That's not something that's enforcable. How can they show that my communication isn't cosmic background radiation I'm gathering for research. Or that this poem of seemingly random words really is encoded data and not just bad poetry. Or that the pixels in this picture of a cat were intentionally slightly altered in an apparent random fashion.

Not only is it wrong morally to prevent people from privacy in their communications, it's also completely unenforcable. You might as well make laws that 2+2=5 under certain circumstances for all the good it will do. Reality and math don't care about man-made laws.
