Is it reasonable to open up a dispute at this point?

I made a purchase around one week ago for five hits of acid from southpole, he promptly marked it as shipped but in the order details he said that he has been on backorder for the past few weeks and I could either retain my spot in the queue or request cancellation, I messaged him back that I'd like to have my order cancelled last Friday morning, I've since messages him three times since my original message and his alphabay profile indicates that he has been online several times since the first message but he has yet to reply or otherwise indicate that he has read my messages

yeah that is brutal, you would think he would refund your $15 or whatever it is, right away.
