My main question is that can you get in trouble for simply using the darknet markets.
Is it legal to sell legal goods on darknet markets?

no taxes are paid, so I'd say it's illegal

No. It's not. DPR got taken down because he created, ran and profited from a site that facilitated drug trafficking. That's a crime. But utilizing a site designed to traffic drugs to sale, old Black Sabbath records would be perfectly legal. (but I'm no lawyer)

Legal as in to the government, or "legal" to the darknet market administrators? Because they're cool with you selling legal items, except for guns. Don't sell guns on marketplaces that don't allow for gun sales, or else you will be doing an illegal action in their eyes.
The usual speculation is that it may be criminal due to the commissions taken by market operators: RICO is mentioned due to the broadening of its applicability in the

case.In practice, it's rare for legal sellers to get in trouble. The only example I know of is PlutoPete in the UK, and speculation is that the cops either made a mistake or they were hoping to get info about his customers (some of whom were almost certainly sellers themselves).
