This undermines the very reason we have a justice system.
Let me leave this here: http://i.imgur.com/Nmh6zcN.png

How can you hold someone "indefinitely" without charges? That's all kinds of fucked up.
I'm sure there's a bunch of kiddy porn on there, but holding a guy in a cell without charges indefinitely on a forensic tech "best guess" is pretty shit.

Fuck. The obvious fact that the Fifth Amendment to the U.S. Constitution protects a defendant from being compelled to reveal their encryption passphrase(s) has been largely unchallenged in the modern era, with a couple of exceptions. Unlike in the U.K., crypto users in the U.S. have long had fairly good reason to believe that their encrypted data is secure against prosecution (as long as another person doesn't also have the ability to decrypt it, in which case they can legally be compelled to divulge or use that information).
This is a watershed case and I am glad that the EFF is doing their part to protect the rights of all Americans and anyone who deserves the basic rights to privacy that crypto technologies can help provide. I encourage all people concerned with the future of privacy to support the EFF to whatever extent they're able (Bitcoin accepted). The government must not be allowed to undermine crypto security through threat of violence.

This is fucked up, at least in my country we have the right to lie to the Court (in a criminal case), so even if the judge orders you to note down your password you could always lie
[1 Points] you-are-a-cop:
"I don't know what the password is anymore, your honor. You see, this entire ordeal has taken me by surprise and has been extremely stressful and overwhelming. When this data was encrypted, it was nearly a year ago and has not been accessed since that time."
Don't be a tough guy with investigators and say, "HAHA! You'll never get the password!" That's just dumb...because with the current precedent in case law, you end up being held in contempt...like this moron.
Demonstate otherwise, Mr. US Attorney.
On a side note--sick that yet ANOTHER cop is accused of this shit. My god...what a dysfunctional group of people...the police.
