Title: hypothetical situation
Post by: eunoia on January 26, 2012, 08:32 pm
A person living in an apartment has his door and mail keys swiped by a person he has a relationship with. The person then takes his mail, which contains some pot and acid, and threatens to call police.

Is it more likely that this person gets arrested for stealing keys and mail and then for possessing drugs? Or could the tenant get into trouble?

Who's to say they didn't just put the cid and pot into an envelope with your name on it themselves?

Mail theft is a crime, and after they took it into their hands nobody can prove that they didn't put the drugs there themselves.

This is entirely correct. I'd be careful if they know where your stash is, though; personally, I'd move it someplace they don't know about so that if they decide to tell the police about it, it won't be there. I hope you reach a better resolution, though. =/

Not much to add that hasn't already been said, but man, your girlfriend sounds like a bitch bro.  Why would anyone else purposely try to rat someone out to the cops like that...so pathetic.

BURY YO STASH.

seriously though..

Stealing/opening someone else s mail = crime
pot & acid = crime

just deny everything and you'll be fine..erase history on your comp too..

Deleuze is correct... the old saying 'Possession is nine tenths of the law' is more than just a saying.

"This principle can be restated as: "in a property dispute (whether real or personal), in the absence of clear and compelling testimony or documentation to the contrary, the person in actual possession of the property is presumed to be the rightful owner. The shirt or blouse you are currently wearing is presumed to be yours, unless someone can prove that it is not."

http://en.wikipedia.org/wiki/Possession_is_nine-tenths_of_the_law

The first thing a cop always trys to do is determine possession... if you friend is in possession it is his... his story may say otherwise but that is not up to the cop to decide. What the cop does know is he was dispatched to a person who was in 'possession' of narcotics... he can say where he got them till he is blue in the face but that still doesn't negate the fact that he possessed them... now had he snitched you out and told the cops where the drugs were at and they could prove they were yours based on them being in a location only you had access to then they might have a case against you.

hope it helps.

I had a similar situation many years ago but with different circumstances but essentially the same threats were made towards me.

If these threats have been made by email and/or phone make sure you keep evidence of them!

Blackmail is a very serious offence way more serious than possession of a little bit of pot and some acid.

Remind the instigator that you have clear evidence showing an attempt at blackmail and you will find they will disappear very quickly.

Tell her/him to go for it.

When the police come and ask them why they have opened mail in their possession that doesn't have their name on it and that you emphatically deny having ever given her the package or given her access/permission to your mailbox you'll be the one with the mile long smirk on his/her face when the police take him/her down to the station.

It's even better if you never received the mail (aka it came in your mailbox after she/he stole your keys and you never saw or TOUCHED the package yourself).  She/he is going to have a damned hard time explaining how they didn't steal your mail when your mail is outside of your mailbox with none of your fingerprints on it.
