Title: Can empty capsules be considered illegal? (interpreted as drug paraphernalia)

I know that empty capsules can be bought in health or grocery stores in some places (like California) over the counter with no problem, as they're used for vitamins, herbal supplements, etc.

California is a little different from other places in the US, though. Does anyone know if capsules are/have been/could be interpreted as drug parephernalia in other states? I'm asking because I haven't been able to find any in any stores around my current location and I was wondering why that might be.

if you have a baggie full of molly or w/e ur putting in there and some caffeine or w/e u use to cut and a milligram scale then ur pretty much fucked cuzz there's no way ur beatin that distribution charge.... but if all you have is a 100% completly clean scale and no bags, capsules, or illegal resude then you should be good. this is from a a fellow SR buyer with a past life... lol (BTW I ALWAYS TAKE THESE PRECATUIONS AND MORE YOU CAN NEVER BE TOO SAFE!!!!!)

Sorry, I don't think I follow you completely. So having clean capsules would be legal everywhere, but if they were found ALONG WITH some molly they could be interpreted as paraphernalia?

I guess my question would be better phrased as: Is there anywhere in the US where it is illegal to receive a shipment of empty capsules?

To answer your question: No. It's legal everywhere.

By itself, the capsules are perfectly legal and receiving a shipment of them is perfectly legal.
If you happen to have a whole bunch of powder-based drugs that tend to work best in capsules, then it's still legal to receive the capsules because they're innocuous.
But if you get caught with empty capsules and some drugs that work best in those capsules, you're probably a little bit fucked.
